Welcome to Tropical Retreats Home and Garden (“Tropical Retreats Home & Garden”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website and online store at tropicalretreatshomeandgarden.com (the “Site”) and your purchase of products from us.
By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1) Who we are & how our store works (dropshipping)
We sell home, garden, and home décor products. We operate a dropshipping model, meaning some items are stocked and shipped by third-party suppliers or their logistics partners. We remain responsible for your customer service and for complying with applicable consumer laws.
2) Eligibility & account

You must be at least 18 years old (or the legal age of majority in your location) to purchase from the Site.

If you create an account, keep your credentials confidential and ensure your information is accurate. You are responsible for activity under your account.
3) Orders, acceptance & cancellations

Your order is an offer to buy; we may accept or reject at our discretion (e.g., stock issues, address problems, suspected fraud, pricing errors).

We confirm receipt via email; acceptance occurs when we dispatch or otherwise confirm acceptance.

If we cannot fulfil all or part of your order, we will cancel the affected items and refund you for the unavailable items.

Once submitted, orders may not be editable. Contact us promptly for help—where possible we’ll assist before dispatch.
4) Pricing, currency, taxes & duties

Prices are listed in the currency shown at checkout and may change without notice.

Taxes (e.g., GST/VAT/sales tax) are shown at checkout where applicable.

International orders: Import duties, taxes, and customs clearance fees may apply on delivery and are your responsibility unless we explicitly state otherwise at checkout.
5) Payment methods
We accept Stripe (credit/debit cards) and PayPal. Payments are processed by those providers; we do not store full card details. Your bank may place authorisation holds. If a payment is declined or reversed, we may cancel the order.
6) Shipping, delivery times & tracking

We ship to Australia, the European Union, the United Kingdom, and the United States (including California). Some remote locations may be excluded or require extra time/cost.

Estimated dispatch/delivery windows are displayed at checkout and order confirmation. Because of dropshipping and customs, typical delivery is ~7–28 business days, but times vary by product and destination.

We’ll provide tracking where available. Delivery dates are estimates only and not guaranteed.

If a package is refused, unclaimed, or returned due to incorrect address or non-payment of duties, we may deduct associated costs from any refund (unless required otherwise by local consumer law).
7) Risk of loss & title
Title passes to you when we receive full payment. Risk of loss passes on delivery to the address you provided (or to the carrier if you nominate your own).
8) Returns, refunds & exchanges
We want you to love your purchase.
Change of mind (where permitted):

You may request a return within 30 days of delivery for eligible, unused items in original packaging. Some products are not returnable for hygiene or customisation reasons (e.g., opened bedding, used items, personalised goods, gift cards).

You are responsible for return shipping costs unless the item is faulty, damaged, or misdescribed.
Faulty, damaged, or incorrect items:

Contact us within 30 days with photos and your order number. We will arrange a remedy in line with your local consumer rights (repair, replacement, or refund).

Keep all packaging and documents until your claim is resolved.
Refunds:

Once approved, refunds are issued to your original payment method (processing times depend on your bank/PayPal/Stripe).

For multi-item orders, we may refund affected items only.

9) Product information, availability & variations
We aim to keep product descriptions, dimensions, colours, and images accurate; however, slight variations may occur (e.g., colour differences due to display settings or supplier batches). Availability can change without notice. If a material error is discovered after you order, we’ll contact you to cancel or offer alternatives.
10) Promotions, coupon codes & gift cards
Promotions and codes are subject to their specific terms, cannot be redeemed for cash, and usually cannot be combined. Gift cards (if offered) are non-refundable unless required by law.
11) Third-party services
Our Site uses third-party services we do not control (e.g., Wix platform, Stripe, PayPal, analytics, shipping carriers). Your use of those services may be subject to their terms and policies. We are not responsible for third-party websites linked from the Site.
12) Acceptable use
You agree not to:

interfere with or disrupt the Site or security features;

use bots/scrapers without permission;

submit false, misleading, or fraudulent orders or reviews.
We may suspend or terminate access for violations.
13) Intellectual property
All content on the Site (text, graphics, logos, images, product data, and code) is owned by or licensed to us and protected by law. You may not copy, reproduce, modify, or redistribute content except as allowed by law or with our written permission.
14) Reviews & user content
If you submit reviews, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for marketing and operational purposes. Do not post unlawful, defamatory, or infringing material. We may moderate or remove submissions at our discretion.
15) Privacy & cookies
Your privacy matters to us. Our Privacy Policy and Cookies Policy explain how we collect, use, and share personal information (including under GDPR/UK GDPR, CCPA/CPRA, and the Australian Privacy Act). By using the Site, you acknowledge those policies.

16) Warranties, consumer guarantees & disclaimers

17) Limitation of liability
To the extent permitted by law, we are not liable for: (a) indirect, incidental, special, or consequential losses; (b) loss of profits, revenue, data, or goodwill; or (c) amounts exceeding the total price you paid for the product(s) giving rise to the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded by law. Your statutory rights remain.
18) Indemnity
You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms or misuse of the Site, except to the extent caused by our negligence or breach of law.
19) International customers
You are responsible for complying with local laws and import restrictions in your location. Mandatory local consumer protection laws apply in addition to these Terms and, where they conflict, your mandatory rights prevail.
20) Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, strikes, pandemics, carrier disruptions, customs delays, governmental actions).
21) Changes to the Site or these Terms
We may update products, prices, and these Terms from time to time. Changes take effect when posted to the Site (the “Effective date” above). For material changes affecting existing orders, we will honour the Terms in effect when you placed your order.
22) Disputes, governing law & venue
These Terms are governed by the laws of Queensland, Australia, and the Commonwealth of Australia, without regard to conflict-of-laws principles.
You and we submit to the exclusive jurisdiction of the courts of Queensland for disputes arising from these Terms or your purchase, except that consumers in the EU/UK/US may have the right to bring claims in their home courts under mandatory local laws.

23) Severability, no waiver & assignment
If any provision is unlawful or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining Terms remain in effect. Our failure to enforce a provision is not a waiver. We may assign our rights and obligations; you may assign only with our written consent.
24) Entire agreement & electronic communications
These Terms, together with our Privacy Policy and Cookies Policy, are the entire agreement between you and us regarding the Site and purchases. By using the Site, you consent to receive communications electronically (emails, on-site notices).
